SINGLE AGENCY means that in a given transaction, the Broker represents only one party, the buyer or the seller. The ultimate purpose of the single agency is to have equal representation for buyer and seller alike.
Example: If you were in litigation, would you use your opponent's attorney? In cases where a buyer seeks help from a Broker who is working for the seller, there are too many important questions that go unasked prior to the sale. Again, for example, when the seller wants the highest possible price with few or no terms, while the buyer wants the lowest price and easy terms, how can one Broker provide truly professional service to parties with opposite objectives?
When you, as a buyer, enter into a discussion with a Broker regarding a transaction, you should understand from the beginning the type of relationship or representation you wish to have with the Broker. As a buyer, it is of great importance to find out who the Broker represents. This understanding will make your chances for a comfortable, successful and secure transaction much greater.
It is important to understand that in most cases, when you are buying property, Brokers represent the seller unless special arrangements are made initially for the Broker to represent you. You are generally the Broker's customer or prospect, and the seller is the client or principal.
If the Brokers company signs a listing contract with the seller, agreeing to find a buyer for the property that contract creates a fiduciary relationship, which means that the Broker, INCLUDING ALL ITS SALES AGENTS, must put the seller's interest above all others - the Buyer, the Broker, or anyone else. This is simply what any Client deserves.
The choice is clearly yours. DO YOU WANT to be the CLIENT or the CUSTOMER? Why not obtain the representation you deserve. Full disclosure, fiduciary, confidentiality and peace of mind are yours just for the asking.
